Car Rental Agreement Without Driver
The contracting parties, the company and the renter, agree to the following terms. The renter mentioned in this contract undertakes to comply with the following clauses:
Article 1:
The renter must check the condition of the vehicle before taking charge of it. Once the vehicle is handed over, the renter becomes solely responsible for it.
Article 2:
The renter undertakes to maintain the rented vehicle, use it reasonably, and remain responsible for any damage caused to it, in accordance with Article 663 of the Code of Obligations and Contracts.
Article 3:
In accordance with Article 674 of the Civil Code, the renter must immediately inform the company of any event requiring its intervention, whether it involves urgent repairs, an unexpected discovery, theft, or damage caused by third parties. Failure to do so will result in the renter bearing full responsibility for all damage caused to the rented vehicle.
Article 4:
The renter undertakes not to transfer or sublet the rented vehicle to another person and not to use it for purposes other than those specified, in accordance with Article 669 of the Civil Code.
Article 5:
The renter may not claim damages from the company for delays in delivering the vehicle, termination of the contract between the parties, or the duration of repairs resulting from a breakdown, even if such breakdown is normal during the rental period.
Article 6:
The renter must not leave the vehicle documents, including the rental contract and keys, inside the vehicle when leaving it.
Article 7:
The renter undertakes to return the vehicle during the company’s opening hours; therefore, the vehicle remains in the renter’s possession and under their responsibility until the company reopens.
Article 8:
The renter undertakes to return the rented vehicle to the company at the end of the period specified in the rental contract, under penalty of legal action in accordance with Articles 574, 525, and 505 of the Moroccan Penal Code.
Article 9:
The renter must pay the company in advance an amount specified in the insurance contract.
Article 10:
The company undertakes to reimburse this amount if the rented vehicle is returned in the same condition in which it was delivered to the renter at the beginning of the contract.
Article 11:
The renter undertakes to inform the company 24 hours before the end of the rental period in order to extend the rental contract.
Article 12:
The company reserves the right to accept or refuse the extension of the rental contract. If the company refuses to extend the rental period and the rented vehicle is not returned on the date specified in the contract, the company has the right to immediately retrieve the vehicle and take legal action against the renter
